Terms of Service

Welcome to GPTQuest. These Terms of Service ("Terms") govern your access to and use of the GPTQuest website, games, and services ("Service") provided by Kixmeta Labs, LLC ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using GPTQuest, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Changes to Terms

We may update these Terms at any time by posting the updated version with a revised "Last Updated" date. Continued use after updates constitutes acceptance of the revised Terms.

3. Eligibility

The Service is designed for users aged 13 and older. If you are between 13 and 18 (or age of majority in your region), you may use the Service only with parental consent. By using GPTQuest, you represent that you meet the applicable age requirement.

4. Account Registration

Certain features, including progression tracking and purchases, require an account. You agree to provide accurate information and maintain the security of your account credentials. You are responsible for all activity under your account.

5. Description of Service

GPTQuest is a platform offering short narrative fantasy games ("Quests") powered by AI and authored game design. Each Quest is a self-contained interactive narrative where players use natural language to shape outcomes.

Some Quests support:

• Solo play (1 player)
• Cooperative play (multiple players)
• Versus play (competitive matchups)

Each Quest lists the number of players supported. Only the host of a multiplayer session must own the Quest; invited guests can participate without purchase.

6. Purchases and Payments

Premium Quests are available for a one-time purchase. After you buy one, it unlocks permanently on your account. Prices are shown in the Service and may change at our discretion.

By purchasing, you authorize charges to your selected payment method. All purchases are final and non-refundable, except where required by law.

7. Gems and Virtual Currency

What Are Gems?

Gems are a virtual currency used within GPTQuest to unlock premium Quests. Gems may be purchased with real money or earned through certain in-platform activities as specified by GPTQuest.

Purchasing and Use

• Gems are bought in defined packs (e.g., 250 Gems, 500 Gems) for real currency through the Store section of the Service.
• Once Gems are purchased and credited to your account, they may be used to unlock premium Quests.
• A Quest unlocked with Gems becomes permanently accessible on your account; you will not be charged again for the same Quest.
• Only the host of a multiplayer Quest needs to unlock a Quest with Gems. Guests may join and play free Quests and unlocked premium Quests without purchasing them.

Earning Gems

GPTQuest may offer opportunities to earn Gems without direct purchase (e.g., a daily free Quest reward of 1 Gem). The availability and mechanics of such offers are determined by GPTQuest and may change at any time.

Non-Refundable

• Gems are non-refundable. Once purchased or earned, Gems cannot be redeemed for cash, refunded, or transferred to other users, except where required by applicable law.
• Any unused Gems remaining in your account after purchasing a Quest will remain in your balance for future use unless otherwise specified.

No Monetary Value Outside the Service

Gems are a virtual, in-game currency and have no value outside of GPTQuest. They do not represent real money or a claim on real money and cannot be exchanged for actual currency outside of the Service.

Expiration and Modification

GPTQuest reserves the right to modify the pricing, availability, and functionality of Gems at any time. Gems may be subject to expiration or removal at GPTQuest's discretion, provided that no action affects previously completed purchases without notice where required by applicable law.

Violations and Abuse

Attempting to manipulate, duplicate, or fraudulently acquire Gems may result in suspension or termination of your account and forfeiture of your Gems, in addition to any other remedies GPTQuest may pursue.

Discontinuation

If GPTQuest discontinues the ability to use Gems for Quest unlocks or otherwise decommissions the virtual currency system, any unused Gem balance may be forfeited. GPTQuest will provide notice as required under applicable law.

By using the Service and purchasing Gems, you agree to be bound by these rules and any updates to them.

8. Refund & Billing Policy

All purchases of premium content (such as individual Quest unlocks) are final and non-refundable, unless required by applicable law. Once delivered, access to the digital content is considered fulfilled.

Payments are processed through third-party payment providers. You agree to pay all charges associated with your purchase, including applicable taxes.

9. User-Generated Content Policy

GPTQuest allows users to generate narrative content through gameplay. This section explains acceptable use and content guidelines.

Acceptable Content

You agree not to use the Service to create or share content that:

• Is unlawful, harmful, or abusive
• Contains hate speech, threats, or harassment
• Is sexually explicit, pornographic, or exploitative
• Promotes discrimination or violence

User Inputs and AI Output

During gameplay, you may enter text, prompts, or other information ("Input") and receive AI-generated responses ("Output"). As between you and GPTQuest, you retain any rights you may have in your Input. You grant GPTQuest a limited, worldwide, non-exclusive, royalty-free license to host, process, display, and transmit your Input solely to operate, maintain, and improve the Service, including generating Output, providing support, and enforcing these Terms.

Moderation and Enforcement

GPTQuest may remove, restrict, or refuse content or access to the Service if it violates these Terms or is harmful or inappropriate. Repeated or serious violations may result in account suspension or termination.

Reporting

If you encounter content that violates these guidelines, use the in-app reporting feature or reach out via our Contact Us page and select "Report" from the dropdown.

10. AI Content Disclosure & Safety

GPTQuest uses artificial intelligence to generate narrative responses within designed rules and constraints. AI is a tool that helps create dynamic storytelling based on player input.

AI Limitations

AI-generated narrative content is provided "as is." Due to the nature of generative systems:

• Output may be imperfect, inconsistent, or unexpected
• We do not guarantee accuracy, completeness, or appropriateness for every context

We strive to filter inappropriate content and maintain safe interactions, but we do not guarantee that all AI output will be error-free or meet individual expectations.

User Responsibility

You agree that your reliance on AI-generated narrative content is at your discretion. You should not consider AI outputs as factual or authoritative.

11. Safety and Conduct

You agree not to use the Service to generate, request, or share content (including prompts, messages, or usernames) that:

• Is unlawful or infringes intellectual property or other rights
• Is threatening, harassing, hateful, defamatory, or encourages violence
• Is sexually explicit, exploitative, or otherwise inappropriate (especially involving minors)
• Encourages self-harm or dangerous behavior
• Shares personal or private information about others (doxxing)
• Involves scams, impersonation, or attempts to bypass safety controls or disrupt the Service

We may remove content, restrict access, suspend sessions, or terminate accounts for violations.

12. Multiplayer and Hosting

Hosting a Quest allows you to invite other users into a shared session. Guests may play free but cannot host without purchasing the Quest. We may terminate or suspend sessions that violate these Terms.

13. Privacy and Data

Your use of the Service is subject to our Privacy Policy, which explains data collection and use. We recommend you review that policy carefully.

14. Termination

We may suspend or terminate your access for violation of these Terms or for any reason. Upon termination, purchased content remains licensed to you under these Terms unless required otherwise by law.

15. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

16. Limitation of Liability

To the maximum extent permitted by law, GPTQuest and its affiliates will not be liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill.

Our total liability will not exceed the amount you paid for the Service in the 12 months preceding any claim, or $100 (whichever is greater).

17. Indemnification

You agree to indemnify and hold harmless GPTQuest and its affiliates from claims, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

18. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflicts of laws principles. Disputes will be resolved in courts of Florida.
