The terms that govern how you use GPTQuest. Plain language where we can.

Welcome to GPTQuest. These Terms of Service ("Terms") govern your access to and use of the GPTQuest website, games, and services ("Service") provided by Kixmeta Labs, LLC ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using GPTQuest, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Changes to Terms

We may update these Terms at any time by posting the updated version with a revised "Last Updated" date. Continued use after updates constitutes acceptance of the revised Terms.

3. Eligibility

The Service is designed for students in grades 3-8. During the current launch period, GPTQuest accounts may be registered only by adults. The adult who registers an account (the "Account Owner", typically a teacher or school administrator) creates and manages all Student and Teacher accounts through the Control Panel; Teacher accounts have access only to the classrooms the Account Owner assigns to them.

Users under 13 may use the Service only through a school-managed Student account, created on their behalf under the COPPA school authorization exception. By creating Student accounts, the Account Owner confirms they are authorized by their school or district to do so for educational purposes, and that the school has provided (or will provide) any required notice to parents under applicable law.

Account Owners using the Service outside a traditional school setting (e.g., homeschool co-ops, after-school programs) are responsible for obtaining verifiable parental consent before creating accounts for any child under 13, as required by COPPA.

4. Account Registration

You agree to provide accurate information and maintain the security of your account credentials. You are responsible for all activity that occurs under your account.

5. Description of Service

GPTQuest is a platform offering short narrative fantasy games ("Quests") powered by AI and authored game design. Each Quest is a self-contained interactive narrative where players use natural language to shape outcomes. The Service also includes the World, a shared hub map where players create an avatar, explore, start Quests, and spend earned rewards (such as gold and Quest items) on avatar cosmetics; each classroom's World runs as its Teacher's private Instance.

Some Quests support:

  • Solo play (1 player)
  • Cooperative play (multiple players)
  • Versus play (competitive matchups)

Each Quest lists the number of players supported. Premium Quests can be started by School Pro subscribers and by Students and Teachers managed under an Account Owner with an active School Pro subscription. Free multiplayer Quests can be started by any Teacher or Student. Multiplayer sessions are scoped to each Teacher's private Instance. Only that Teacher and the Students they manage can play together.

6. Purchases and Payments

Premium Quests are available through a School Pro subscription. Prices are shown in the Service and may change at our discretion. By subscribing, you authorize recurring charges to your selected payment method, including any applicable taxes.

If you believe a billing error has occurred, please reach out via our Contact Us page and select "Billing" from the dropdown.

7. Gems and Virtual Currency

Gems are a virtual reward currency earned by completing certain Quests within GPTQuest. Gems cannot be purchased with real money and have no monetary value inside or outside the Service.

Gems may be used for in-platform rewards as specified by GPTQuest. The availability and mechanics of earning Gems are determined by GPTQuest and may change at any time.

GPTQuest reserves the right to modify the availability and functionality of Gems at any time.

8. Refund & Billing Policy

Payment Processing

Payments are processed by Stripe. School Pro is billed per seat, with a minimum of 12 seats per subscription. Adding seats during an active billing cycle is prorated automatically by Stripe so that you are only charged for the remainder of that cycle.

Cancellation

Subscriptions may be cancelled at any time. When you cancel, your subscription remains active until the end of the current billing period and is not renewed. Students managed under a cancelling Account Owner will lose access to premium Quests at the end of the same billing period.

Annual Subscriptions

Annual subscriptions remain active for the full year that has been paid for. Cancelling does not refund the unused portion of an annual term.

Account Deletion

Closing your GPTQuest account deletes the account immediately. Any active subscription stops renewing as part of account closure, and no refund is issued for time remaining on the current billing period, including any unused months on an annual subscription.

If you have an active subscription, we recommend cancelling the subscription and keeping the account active until the current billing period ends, rather than closing the account right away. Cancelling lets you continue using School Pro through the time you have already paid for, while closing the account ends your access at once.

Refunds

All subscription payments are non-refundable, except where required by applicable law.

9. User Content and License

User Inputs and AI Output

During gameplay, you may enter text, prompts, or other information ("Input") and receive AI-generated responses ("Output"). As between you and GPTQuest, you retain any rights you may have in your Input. You grant GPTQuest a limited, worldwide, non-exclusive, royalty-free license to host, process, display, and transmit your Input solely to operate, maintain, and improve the Service, including generating Output, providing support, and enforcing these Terms. Any use of student Input to improve the Service occurs only in aggregated, de-identified form, as described in our Privacy Policy and, for schools, our Data Privacy Agreement, which controls with respect to student data.

Reporting

If you encounter content that violates these Terms, use the in-app reporting feature or reach out via our Contact Us page and select "Report" from the dropdown.

10. AI-Generated Content Disclaimer

How AI Is Used in the Service

GPTQuest uses artificial intelligence to generate narrative responses within designed rules and constraints. AI shapes dialogue, branching, and outcomes alongside authored game design.

AI Output Is Imperfect

AI-generated content is provided "as is." Generative systems may produce output that is inaccurate, inappropriate, biased, offensive, factually wrong, inconsistent with the intended Quest, or otherwise unexpected. Causes can include:

  • Limitations or errors in the underlying AI models ("hallucinations")
  • Bugs or misconfigurations in our prompts, filters, or game logic
  • Adversarial input, where players intentionally push the AI to generate content outside its guardrails
  • Edge cases we have not yet anticipated or tested

We work to limit harmful or off-topic output through filters, prompt design, and Quest structure, but we do not and cannot guarantee that AI output will be appropriate for every player or context.

If You Encounter Problematic Output

Please report it through the in-app reporting feature or via our Contact Us page (select "Report"). We take reports seriously, investigate them, and ship fixes when problems are reproducible.

Acknowledgment and Waiver

By creating or maintaining a GPTQuest account, you acknowledge that AI output may at times be incorrect, harmful, or unintended, and that you use the Service with that understanding. You agree not to treat AI output as factual, professional, medical, legal, financial, educational, or safety advice. To the maximum extent permitted by law, you release GPTQuest, Kixmeta Labs, LLC, and our affiliates from any claim, demand, or cause of action arising out of AI-generated output, and you agree not to bring such a claim against us in court or any other forum, except where such a release is prohibited by applicable law (including laws protecting minors). This acknowledgment and release applies to every account holder, including Account Owners and Teachers, who agree to these Terms as adults on their own behalf.

Teacher Responsibility

Teachers using the Service in a classroom context are responsible for reviewing how the Service fits their school's policies and for supervising student gameplay accordingly.

11. Safety and Conduct

You agree not to use the Service to generate, request, or share content (including prompts, messages, or usernames) that:

  • Is unlawful or infringes intellectual property or other rights
  • Is threatening, harassing, hateful, defamatory, or encourages violence
  • Is sexually explicit, exploitative, or otherwise inappropriate (especially involving minors)
  • Encourages self-harm or dangerous behavior
  • Shares personal or private information about others (doxxing)
  • Involves scams, impersonation, or attempts to bypass safety controls or disrupt the Service

We may remove content, restrict access, suspend sessions, or terminate accounts for violations.

12. Multiplayer and Hosting

Hosting a multiplayer Quest opens a shared session for players in your Teacher's private Instance to join. Eligibility to host premium and free multiplayer Quests is described in Section 5. We may terminate or suspend sessions that violate these Terms.

13. Privacy and Data

Your use of the Service is subject to our Privacy Policy, which explains data collection and use. We recommend you review that policy carefully.

14. Termination

We may suspend or terminate your access for violation of these Terms or for any other reason at our discretion. Termination ends access to the Service, including any virtual items on the account, such as Gems, images, music, and other in-Service content. Subscription treatment on termination is described in Section 8.

15. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. This disclaimer includes AI-generated output, which is further described in Section 10.

16. Limitation of Liability

To the maximum extent permitted by law, GPTQuest and its affiliates will not be liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill. To the extent permitted by law, this also excludes liability for AI-generated output, as further addressed in Section 10.

Our total liability will not exceed the amount you paid for the Service in the 12 months preceding any claim, or $100 (whichever is greater).

17. Indemnification

You agree to indemnify and hold harmless GPTQuest and its affiliates from claims, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

18. Dispute Resolution & Mandatory Arbitration

Informal Resolution First

Before filing any formal claim, you agree to first contact us via our Contact Us page and try to resolve the dispute informally for at least sixty (60) days. We will do the same before bringing any claim against you. Most disputes can be resolved this way.

Binding Arbitration

If informal resolution does not succeed, any dispute, claim, or controversy arising out of or relating to these Terms or the Service (including AI-generated output) shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in New York or, at your election, by phone or video. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

You and GPTQuest agree that any dispute will be brought only in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Exceptions

This arbitration provision does not apply to:

  • Claims that may be brought in small-claims court
  • Claims for injunctive or other equitable relief to prevent the actual or threatened infringement of intellectual-property rights
  • Claims that applicable law does not allow to be arbitrated, including certain claims involving minors

Opt-Out

You may opt out of this arbitration agreement within thirty (30) days of first creating a GPTQuest account by sending written notice via our Contact Us page with the subject line "Arbitration Opt-Out" and including your account email. Opting out does not affect the rest of these Terms.

Severability and Survival

If any portion of this Section is found unenforceable, the remainder of these Terms remains in effect. This Section survives termination of your account.

19. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflicts of laws principles. Disputes that fall outside the arbitration agreement in Section 18 will be resolved in the courts of New York.
